Responsibilities

  • manage all contractual issues related to large and medium size projects
  • working in close cooperation with the project director and supporting the team regarding commercial aspects of sourcing/procurement and management of subcontractor's and supplier contracts
  • set up and draft subcontracts, pass-through the main terms and conditions from the main contract into subcontracts and supplier purchase orders and lead the negotiations based on the strategy aligned with the management and the project directors
  • analyses and clarifies the commercial contractual rights and obligations of the company in relationship with subcontractors and suppliers
  • supports the definition of interfaces between the different project stakeholders as well as the involved companies and experts
  • set up and draft contract amendments and subcontracts and lead the negotiations based on the strategy aligned with the management and the project directors
  • drive the change order and claim processes incl. insurance cases
  • support the invoicing processes
  • Collaborate with Legal, Sourcing, Procurement and Quality regarding contract management and best practices for process development
  • Work with team to ensure processes followed regarding pass-through terms and conditions for subcontracts and supplier purchase orders
  • Support the execution start-ups of projects, including contract analysis and preparation of Project Contract Commercial Plans
  • Assume responsibility for all project contractual activities from hand over from Sales/Commercial until all relevant contractual obligations are complete, including financial reconciliation, and all relevant contractual issues are resolved/ settled
  • support the team in the identification of Customer / Consortium and other third-party obligations and development and implementation of the Project Contract Commercial Plan, including Project Claim Strategy
  • Liaise with the Project Director regarding commercial strategy development and execution to ensure that the contract schedule is met and appropriate schedules for subcontracts are produced and maintained, to support Project Claim Strategy
  • Support project risk and opportunity identification and analysis. Support the management of risks and opportunities by development and implementation of appropriate Project Contract Commercial Plan
  • Ensure proper notices are given in line with contract requirements
  • Management of claims to/from customers and consortium partners
  • Support the management of claims to/from subcontractors and suppliers as required
  • Establishment and implementation of project specification contractual procedures, particularly regarding claims, insurance, variation orders, correspondence and notifications
  • Support and guide the Project Management team in general contractual issues
  • Clarification of contractual/legal queries, if required by referring to Legal
